Snowmass Village Police Department reminds all motorists that a new Colorado law bans mobile device use while driving to improve road safety. The new law took effect January 1, 2025, and aims to reduce distracted driving accidents across the state.

In a significant move to enhance road safety and reduce distracted driving, Colorado will implement a new law beginning January 1, 2025, prohibiting drivers from using mobile electronic devices while behind the wheel. The law, designed to help reduce distractions and prevent accidents, expands the existing ban to include not just texting but any manual use of a mobile phone or other devices for voice calls, navigation, or other purposes.

Drivers are still permitted to use hands-free accessories, which allow them to keep their focus on the road while staying connected. Hands-free options include Bluetooth headsets, dashboard mounts, and in-car systems such as Apple CarPlay and Android Auto.

Key Provisions of the New Law:

  • Ban on Manual Use of Mobile Devices: The law prohibits drivers from holding or manually using a phone or mobile device for any reason, including voice calls or navigation.
  • Hands-Free Use Allowed: Drivers can use hands-free devices like Bluetooth headsets, dashboard mounts, or car speaker systems to maintain connectivity while ensuring safety.
  • Penalties for Violating the Law:
    • First Offense: $75 fine and two license suspension points.
    • Repeat Offenses: Increased fines and license points.
    • Dismissal for First Offenders: First-time violators can have the charge dismissed if they provide proof of purchasing a hands-free accessory.

Exemptions:

The law includes exceptions for certain individuals and situations, such as:

  • Emergency Situations: Drivers reporting emergencies or first responders.
  • Public Service Workers: Utility workers, code enforcement officers, and animal protection officers.
  • Parked Vehicles: Drivers in legally parked vehicles are exempt.
  • Commercial Drivers: The law does not apply to those with a commercial driver’s license operating commercial vehicles.

These exemptions ensure that critical communications are not hindered during emergency or essential service situations.

Hands-Free Accessories:

Hands-free accessories are key to staying connected while driving safely. Drivers can choose from a variety of options, including:

  • Dashboard/Phone Mounts: Keep your phone in a visible, safe position for navigation or hands-free calls.
  • Apple CarPlay/Android Auto: Use your vehicle's system to control your phone through voice commands or the vehicle’s interface.
  • Built-In or Aftermarket Car Speaker Systems: Bluetooth-enabled car systems allow hands-free communication and audio navigation, while plug-in devices can offer the same feature for cars without Bluetooth.

By using hands-free devices, drivers can avoid penalties while helping to make Colorado’s roads safer for everyone.
